HOLIDAY BENEFIT AGREEMENT - TERMS & CONDITIONS

HOLIDAY AND ACCOMMODATION BENEFIT 
INTRODUCTION


This Benefit Agreement is in two parts: 

  • Front Page setting out various items of key information (including the Benefit Period and the salary savings scheme reduction amounts you will have to make); and your
  • Terms & Conditions. 


This Benefit Agreement sets out the basis on which we will allow you to participate in these arrangements.


This Benefit Agreement also varies your Terms & Conditions of employment. Specifically, it sets out the terms on which you agree to give up part of your entitlement to salary in return for the non-cash holiday benefit being providing to you.


Your Salary will be reduced for 12 monthly pay periods and you cannot participate in more than one Holiday Benefit at any time. 


Hays Travel are the provider of the Benefit.

 

Please Note: As mentioned and shown, this is a non-cash benefit on which you make statutory savings. For this compliance reason, your Holiday Package can never be refunded for cash.

 

DEFINITIONS


“Benefit Agreement” means this Benefit Agreement which incorporates these terms & conditions;


“Benefit Period” means the duration of the benefit term stated in this Benefit Agreement;


“Package(s) / Holiday Packages” means your holiday and/or accommodation shown in this Benefit Agreement;


“Monthly Salary Saving” means the monthly payment reduction in your gross salary as set out in this Benefit Agreement;


“Scheme” means this Benefit Scheme;


“We”, “Our” and “Us” means your employer and its benefits operators;


“You” and “Your” means an employee of the employer providing the Holiday Packages as identified in this Benefit Agreement;


“Scheme Provider” means our nominated operator of the Benefit Program;


“Insurers” – where applicable means the insurance is arranged by Hays Travel, ABTA, ATOL. Please check for details of insurance inclusion on the Scheme website;


“Owner” means the individual employee named on the signed Benefit Agreement;

 

 

1. ORDERING, DELIVERY AND COLLECTION

 

1.1 ORDERING


The Holiday Package(s) will only be provided after the approval of your selection(s) by us.
 
1.2 DELIVERY TIME & ARRANGEMENTS


You will be contacted by phone, email and/or text by our Benefit Provider and notified if you are approved and of the delivery arrangements of your Holiday Package(s). 

 

If you have any queries, please either reply to this email or contact: support@1callbenefits.com  Please ensure that you provide an email address for an Account regularly monitored and used by you.

 

1.3 RECEIPT OF PACKAGE(S)


You must ensure, if this is required by any of our holiday Partner(s) that someone is available to acknowledge or sign for any arranged delivery/collection of packages. If no-one is in to receive packages for any reason, then you may be required to collect the packages from a Collection Point or directly arrange for a redelivery. 

 

1.4 CONFIRMATION OF RECEIPT / COLLECTION


At the time that your holiday package/s may be delivered, you will be required to confirm receipt by signing the Supplier’s delivery / collection / confirmation notes. 

 

1.5 DELAYS IN DELIVERY OR COLLECTION


We will not be liable for any delay in delivering the holiday package(s) to you or for failing to deliver the package(s) at all, if that delay or failure is due to any event or circumstance beyond our reasonable control.

 

This includes where we may no longer be able obtain the Holiday Package(s) you have selected. If we are unable to obtain the Holiday Packages(s), we will let you know, and we or you may cancel this Benefit Agreement without any party having further liability to the other.

 

1.6 BEFORE YOU SIGN FOR DELIVERY OF YOUR ORDER

 

Confirm the details of the Holiday Package(s)
When your order arrives; check that the details of package(s) match the documentation provided by the supplier.


If they do not match, please email or contact: support@1callbenefits.com  with any queries you may have. 


If there are any missing Holiday Package(s) details
Please inform us immediately, details or if you have rejected delivery. Please use the "Contact Us" tab on the website or email:

Keep All Your Items Safe
Keep your holiday information package and all the holiday documents safe until all your holiday arrangements have been completed or just in case anything needs to be corrected.

 


2. HOLIDAY ARRANGEMENTS AND HOLIDAY TERMS AND CONDTIONS


2.1 HOLIDAY ARRANGEMENTS
Please read the Holiday/Accommodation arrangements and terms and conditions documents in full.

 

You are responsible for completing and returning any registration or bookings forms and doing anything else needed to arrange your holiday and accommodation.

 

If you are unsure about any holiday arrangements or if you believe the holiday details are incorrect, then you should promptly contact our Benefit Operator, so that if applicable, arrangements can be made to correct this information.

Should you fail to do this, and Holiday / Accommodation arrangements cannot later be altered, you and not us, will be liable for this and Salary Reductions will continue as per the period amount details shown on this signed document.


Note: As this is a non-cash benefit on which you make statutory savings. For this compliance reason, your Holiday Package cannot be refunded for cash.


2.2 INSURANCE COVER CLAIMS HANDLING


2.2.1 You must tell the Operator of any insurance claims you may wish to make. Before doing so, please check your insurance and ABTA certificates accordingly.


2.2.2 By signing the Benefit Agreement you authorise us to pass to the insurers information about you including medical and employment details provided such information is used solely for the purpose of administering insurance affected in relation to this Benefit Agreement and handling any insurance claims. The insurers are authorised and regulated by the Financial Services Conduct Authority.


3. ADJUSTMENT TO YOUR PAY


3.1 SALARY SAVING
By entering into this Benefit Agreement, you agree to the Benefit Period and these Terms and Conditions as stated. In return for us agreeing to obtain this Benefit for you, you hereby agree that your gross salary will change and will be reduced for the Benefit Period and by an amount equal to the Monthly Salary Saving shown. 


This Benefit Agreement shall be taken to be a statement of the change to your employment particulars, as required by Section 4 of the Employment Rights Act 1996 and that your employment remuneration will include this Benefit acquired for you.


3.2 UNPAID LEAVE / SUSPENSION
If you take any unpaid leave such as Maternity / Paternity & Long-Term Illness for any reason during the term of this Agreement, then the salary saving reduction will continue to apply.


However, if for any month your salary is reduced beyond a level at which the salary saving cannot be sustained or you receive no salary as a consequence of such leave, your agreement will remain active for the number of months the salary saving was unable to apply. However, your payments will be suspended for the period of such leave.


On your return, we will recommence the payments to cover the period of unpaid leave and extend the Benefit period accordingly.

 

 

3.3 YOUR PENSION


By entering a Salary Saving agreement, you agree to satisfy yourself of any effect that this may have on your pension benefits.

 

4. TERMINATION OF THIS AGREEMENT


4.1 THIS BENEFIT AGREEMENT IS TERMINATED IF:


(a) You leave your employer, for any reason whatsoever, or


(b) This Agreement has run its full term,


As a result:


You will be required to pay us an amount equal to the total of all Monthly Salary Saving reductions yet to be made. Any monies owing for this Benefit will be deducted from your net final salary, or an invoice will be sent to you for the full amount that is outstanding.


5. YOUR GENERAL OBLIGATIONS


5.1 THIRD PARTY RIGHTS


We reserve the right to appoint any agent(s) to act on our behalf in respect to enforcing this Benefit Agreement. By entering into this Benefit Agreement, you consent to us using and passing personal information about you to the Scheme Operator and its agents for the sole purposes of and only to the extent necessary, to administer the arrangements described in this Benefit Agreement and to operate and finance our Scheme. The Data Protection Act 2018 and current GDPR regulations will apply to that information.


5.6 WAIVER
Any waiver or indulgence by us or failure by us to enforce our rights (whether by oversight or otherwise) shall not affect our right to rely subsequently on any other term(s) of this Benefit Agreement.


We will not have any responsibility under this Benefit Agreement if we are delayed in performing or fail to perform any of our obligations under this Benefit Agreement as a result of circumstances beyond our reasonable control.


5.7 LAW
This Benefit Agreement is governed by English law and the parties submit to the exclusive jurisdiction of the English Courts.
